These Terms of Use (“Terms”) govern your access to and use of michaeldanielinvestments.com and any related pages, forms, or communications (the “Site”), operated by Michael Daniel Investments, Inc. (“MDI,” “we,” “us,” or “our”). By using the Site or submitting an inquiry, you agree to these Terms. If you do not agree, do not use the Site.

2. No Offer, Commitment, or Guarantee

Any loan is subject to full underwriting, satisfactory title and property review, third-party reports, documentation, and final written approval. Not all applicants or properties will qualify. Descriptions of products, processes, or turnaround times reflect general practice and do not guarantee any particular outcome, decision, timeline, or result in your situation.

No statement on this Site should be understood as a promise to stop, prevent, delay, or resolve any foreclosure, default, lien, judgment, or other proceeding. Outcomes depend on facts specific to each borrower and property, and on circumstances outside our control.

3. Business-Purpose Loans Only

MDI originates loans for business or investment purposes secured by real estate. Loan proceeds may not be used for personal, family, or household purposes. A signed business-purpose statement is required at closing.

Because these are not consumer credit transactions, they are not subject to the disclosure requirements and protections that apply to consumer mortgage loans. If you are seeking financing for a personal, family, or household purpose, MDI is not the appropriate lender and you should consult a consumer mortgage lender.

4. Licensing and Origination

Loans are originated by Alex Nelson, NMLS #233991, of 1st Point Lending, Inc., NMLS #151392. Michael Daniel Investments, Inc. is a separate entity and is not itself a licensed mortgage loan originator.

MDI is a private lender. MDI is not a bank, mortgage broker, foreclosure consultant, loan modification service, credit repair organization, or housing counseling agency. We do not negotiate with your existing lender on your behalf, and we do not purchase homes from owners in foreclosure.

9. Intellectual Property

The Site and its content — including text, design, graphics, logos, and the Michael Daniel Investments name and marks — are owned by MDI or its licensors and are protected by intellectual property laws. You may view and print pages for your personal, non-commercial reference. Any other use, including reproduction, modification, distribution, or republication, requires our prior written permission.

The Site links to third-party websites and services, including our scheduling tool and external resources. TO THE FULLEST EXTENT PERMITTED BY LAW, MDI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

14. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue there.

This section governs your use of the Site only. Loan documents, if any, contain their own governing law, venue, and dispute resolution provisions, which control that transaction.

15. Severability and Waiver

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of that provision.

16. Changes to These Terms

We may update these Terms at any time. The “Last updated” date above reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
